Will you be issuing outdated Disclosure Documents?
As a franchisor, the Franchising Code of Conduct (“Code”) requires you to update your Disclosure Document at least once a year – four months after the end of the financial year.
In Australia, a single colour can be the subject of a trade mark application. However, a recent case heard before the Federal Court of Australia has demonstrated just how hard it is to secure a trade mark registration for a single colour, especially in respect of everyday consumer goods, such as food items and beverages.
Under the Franchising Code of Conduct (the 'Code') franchisors are required to annually update their Disclosure Document within four months of the end of the financial year.
